STATE STRUCTURE OF UKRAINE The Constitution establishes the country’s political system.

Ukraine is a sovereign and independent, democratic, social, legal state.

It is a unitary, not a federal state with single citizenship.

Ukraine is a republic.

The people are the only source of power which is exercised through the bodies of state power and local self - government.

The Constitution outlines the structure of the national go - vernment and specifies its powers and duties.

Under the Consti¬tution the powers of the government are divided into three bran¬ches – the legislative, the executive and the judicial.

The only body of the legislative power in Ukraine is parliament – the Supreme Rada (the Verkhovna Rada).

It consists of 450 people’s deputies, who are elected for a term of four years on the basis of universal, equal and direct suffrage by secret ballot.

The Supreme Rada’s main function is making laws.

The Supreme Rada adopts the State Budget for the period from January 1 to Decem¬ber 31 and controls the execution of it.

The President of Ukraine is the head of the state and speaks on behalf of it.

He is elected directly by the voters for a term of five years with no more than two full terms.

The President is the Commander - in - Chief of the armed forces of Ukraine and is responsible for relations between Ukraine and other powers.

The highest body of the executive power is the Cabinet of Ministers.

It is responsible to the President and is accountable to the Supreme Rada.

The Cabinet is headed by the Prime Minister who is appointed by the President and approved by the Supreme Rada.

The Cabinet carries out domestic and foreign policy of the state, develops and fulfills national programs on the economic, scientific and technological, social and cultural development of Ukraine.

Justice in Ukraine is exercised entirely by courts.

It is administered by the Constitutional Court and by courts of general jurisdiction.

The Supreme Court of Ukraine is the highest juri¬dical body of general jurisdiction.

ГОСУДАРСТВЕННАЯ СТРУКТУРА УКРАИНЫКонституция учреждает политическую систему страны.

Украина является Республикой.

Президент является главнокомандующим Вооруженных Сил Украины и отвечает за отношения между Украиной и другими державами.

Высшим органом исполнительной власти является Кабинет Министров.

Кабинет министров возглавляет премьер - министр, который назначается Президентом и утверждается Верховной Радой.

Кабинет министров проводит внутреннюю и внешнюю политику государства, разрабатывает и осуществляет общегосударственные программы экономического, научно - технического, социального и культурного развития Украины.

Правосудие в Украине является исключительно суды.

Оно осуществляется Конституционным Судом и судами общей юрисдикции.

Верховный суд Украины является высшим судебным органом общей юрисдикции.

The Courts in our Country

The court is an organ of state that administers justice on the basis of the laws of the state.

There are courts of first instance and second instance.

A court of first instance examines a case in substance and brings in a sentence or a judgement.

A court of second instance examines appeals and protests against sentences and judgements of courts of first instance.

However, any court may sit as a court of first instance.

The basic judicial organ is the district court.

It tries both criminal and civil cases.

The district court consists of a judge and two assessors.

Cases are tried in public and proceedings are oral.

The participants in the trial (the victim, the accused, the plaintiff, the defendant and others) speak in open court.

The accused has the right to defence.

The highest judicial organ is the country's Supreme Court supervising the activities of all the judicial organs of the state.

As a court of first instance it tries the most important criminal and civil cases.

It also hears appeals against sentences and judgements of lower courts.

Until June 8, 1995, Ukraine's supreme law was the Constitution (Fundamental Law) of the Ukrainian SSR (adopted in 1978, with numerous later amendments).

On June 8, 1995, President Leonid Kuchma and Speaker Oleksandr Moroz (acting on behalf of the parliament) signed the Constitutional Agreement for the period until a new constitution could be drafted.

Order in Ukraine belongs solely to the people and may not be usurped by the State, its organs or officials.

No one may usurp the authority of the State.

Article 6 State authority in Ukraine is realized on the basis of its division into legislative, executive, and judicial power.

Organs of the legislative, executive, and judicial power exercise their authority within the limits prescribed by this Constitution and in accordance with the laws of Ukraine.

Article 10 The state language in Ukraine is the Ukrainian language.

The State guarantees the comprehensive development and use of the Ukrainian language in all spheres of society across the entire territory of Ukraine.

The Russian Federation is a presidential republic.

The President is the head of state and is elected directly by the people.

In fact he has mush power.

The President can even dissolve the Duma if it doesn t agree with his suggestions three times running.

The President has his Administration but it is not part of the Federal Government.
